How to louse up with discrimination!
Wednesday, 20 April 2011 10:25
top-tipsIn this week’s top tips, we’re giving a few examples that can lead you directly to ‘jail’ – or if not jail then a costly direct discrimination claim! So here’s what NOT to do!!

  • Ask your 28 year old applicant what her thoughts are on having a family.
  • Tell your maternity leaver that when she is ready to return to work you will be able to tell her whether there is a slot for her to return to – or not!
  • Tell your newest employee that her recently announced pregnancy may well affect your ability to confirm her probationary period.
  • Suggest your PA takes a trip to La Senza to improve her wardrobe a bit.
  • Speak to your Muslim employee about their Hindu beliefs….
  • Tell an Irish joke to your Irish union rep.!
  • Jokingly offer cosmetic surgery to all women in the workplace aged over 50.
  • Suggest your 60 year old sales guy takes a back seat so the ‘young ‘uns’ can take the customer facing roles.
  • Sack someone at the point at which you decide they are too old to work.
  • Ask your new employee to choose a new first name for work purposes on the basis that the name they have, you find both unpronounceable and un-spellable (is that a word?)
  • Tell your disabled employee that in your view they are not sufficiently disabled as to be permitted to park in the disabled parking bays.

If you have unfortunately found yourself in a little trouble in relation to any discrimination claim, would like advice on any potential claims, are you aware that Jaluch supports many organisations with tribunal claims and grievances – often at a far more commercial fee rate than most solicitors - do get in touch.
