As if the increasing amount of discrimination legislation over the years hasn’t been enough for employers to contend with, the recent EAT ruling in the case of Nicholson v Grainger has confirmed the extension of the scope of what constitutes a ‘philosophical belief’ for the purposes of The Employment Equality (Religion or Belief) Regulations 2003, receiving much media attention.

We have all been bombarded over the past few weeks with news of ongoing (and escalating) disputes within various organisations; with Royal Mail and British Airways being perhaps the most notorious, which may have come as something of a wake up call to many who have perhaps over the past 10-15 years become accustomed to relatively smooth relations between Trade Unions and industry.
