Genuine Occupational Qualification (GOQ) |
There aren't many of these left, but the existence of one of these is the only defence against a recruitment requirement or practice that would otherwise be discriminatory. For example, asking for a black female of between 25 to 30 years of age would be classed as a genuine occupational qualification if you were a film company looking for an actress for a specific role. Of course if you asked for the same criteria for applications to say a shoe shop, you would be guilty of race, sex and age discrimination! There are very few instances in which you can legitimately and safely use these, so tread very carefully and always seek advice first - otherwise remember that not only can a tribunal claim be brought before employment, but compensation for any discrimination claim is uncapped!
