Where it becomes impossible for the contract of employment to continue to operate through circumstances that neither party could have foreseen. For example, an employee being sentenced to two years in prison would make it impossible for him/her to attend work, thus frustrating the contract and avoiding the need for a dismissal or resignation. Although you might wonder how unforeseen the likelihood of imprisonment was to the employee?!
