Dress codes are a bit of a contentious issue and seem to be popping up in the news all the time these days! Don’t be afraid to have a dress code, where employees need special clothes for Health and Safety or come into contact with the public it’s easy to justify. A clear policy is the best method for ensuring everyone knows what is expected of them!
There are some pitfalls; your policy must be careful not to discriminate, the three areas that are most likely to cause issues being disability, gender, or religion. For example male Sikhs must wear a turban and so a policy that forbids headgear would be discriminatory. The case law so far has indicated that dress codes that differ for men and women are not automatically discriminatory, and courts have looked at the overall standard required. Perhaps the best policy may likely to be a dress code that maintains standards but with a degree of flexibility.
