The above Act came into force in the UK on 27 January 1997 and makes it an offence to employ a person with no entitlement to work in the United Kingdom. The Act includes a specific offence of employing persons who are not permitted to work in the UK. For each employee the employer is liable for a £10,000 fine as of February 2008.

Note: be very wary of trying to stay on the right side of this legislation by asking only certain employees for evidence that they have the right to work. If you do this you might open yourself up to a claim of race discrimination given that those you ask to provide evidence are more likely to be those who do not appear to be 'white/UK' ethnic origin. If in any doubt, ask us for some guidance on how to request the evidence you need.
